General Terms and Conditions

1. Scope of Application

These General Terms and Conditions (GTC) apply to all deliveries from Klaas & Kubitza GbR (hereinafter referred to as KK Airsoft) to consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

2. Contractual Partner

The purchase contract is concluded with KK Airsoft GbR, Owners: Marlon Kubitza and Tobias Klaas, Donoper Str. 6, 32694 Dörentrup.

3. Conclusion of Contract

3.1. The presentation of products in the online shop does not constitute a legally binding offer but merely an invitation to place an order.

3.2. By clicking the button [Buy/Order with Obligation to Pay], you place a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending an order confirmation via email immediately after receiving your order.

4. Right of Withdrawal

4.1. If you are a consumer (i.e., a natural person who places the order for a purpose that cannot be attributed to their trade, business, or professional activity), you have a statutory right of withdrawal.

4.2. If you, as a consumer, exercise your right of withdrawal according to clause 4.1, you must bear the regular costs of returning the goods.

4.3. Otherwise, the regulations on the right of withdrawal, which are detailed in the following instructions on withdrawal, apply:

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us, Klaas & Kubitza GbR, Donoper Str. 6, 32694 Dörentrup, info@kk-airsoft.de, by means of a clear declaration (e.g., a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached sample withdrawal form, which is not mandatory. You can also electronically complete and submit the sample withdrawal form or another clear declaration on our website (insert website address). If you use this option, we will immediately (e.g., by email) send you confirmation of receipt of such a withdrawal.

To comply with the withdrawal period, it is sufficient for you to send the notification of exercising the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we must reimburse you for all payments we have received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we receive notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment. We may refuse repayment until we have received the returned goods or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us or to (insert the name and address of the person authorized by you to receive the goods, if applicable) without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

5. Prices and Shipping Costs

5.1. The prices listed on the product pages are final prices plus shipping costs.

5.2. In addition to the stated product prices, we charge a flat rate of EUR 4.99 per order for delivery within Germany. The shipping costs are clearly communicated to you on the product pages, in the shopping cart system, and on the order page.

6. Delivery

6.1. Delivery is only made within Germany by DHL.

6.2. The delivery time is up to 5 days. Any differing delivery times will be indicated on the respective product page.

7. Payment

7.1. Payment can be made optionally via PayPal, shopPay, Google Pay, Klarna, or credit card.

8. Retention of Title

The goods remain our property until full payment has been made.

9. Warranty for Defects

Klaas & Kubitza GbR "KK Airsoft" is liable for defects in accordance with the applicable statutory provisions, particularly Sections 434 et seq. of the German Civil Code (BGB).

10. Dispute Resolution

The EU Commission has created an internet platform for online dispute resolution. The platform serves as a contact point for the out-of-court settlement of disputes regarding contractual obligations arising from online purchase contracts. More information is available at the following link: http://ec.europa.eu/consumers/odr. We are willing to participate in a dispute resolution procedure before a consumer arbitration board. The responsible consumer arbitration board is: Universal Arbitration Board of the Federal Center for Arbitration e.V., Straßburger Straße 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de. We will participate in a dispute resolution procedure before this board to resolve the aforementioned disputes.
